Terms of Service

Welcome to Massage Club! These Terms of Service (“Terms”) govern your use of our mobile massage services provided through our app and website. By accessing or using our services, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, please do not use our services.

1. Acceptance of Terms

By using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. Independent Contractor Status

Massage professionals are considered independent contractors. Massage Club does not employ massage professionals but facilitates connections between clients and independent contractors. Contractors are responsible for their own taxes, insurance, and compliance with local laws.

3. Booking Process and Payment Terms

Our app and website handle payments directly through our third-party processor, Square. Upon booking a service, a pre-authorization hold will be placed on your payment method for the booking amount. This hold will convert to a transaction charge only after the service has been confirmed by the therapist. If the booking remains in “New” status while pending confirmation, clients may cancel the pre-authorization hold at any time, reversing the hold amount on their card.

4. Jurisdiction and Governing Law

Massage Club operates in Canada and the USA. These Terms will be governed by and construed in accordance with the laws of Ontario, Canada. Any disputes arising from these Terms or your use of our services shall be resolved in accordance with Ontario law.

5. Insurance and Liability

All massage professionals must maintain personal liability insurance and be in good standing with their massage associations to legally operate mobile massage services. Clients will be required to sign a Client Intake Waiver prior to their service, which releases Massage Club and the massage professional from any liability for harm arising from the services provided.

Client Intake Waiver Statement: "I understand that massage is designed for relaxation and relief from tension, muscle spasms, or poor circulation. The massage therapist cannot diagnose medical issues/diseases/disorders or perform spine manipulations. Massage should not be construed as a substitute for medical examination, diagnosis, or treatment. I will consult a physician or qualified medical specialist for any ailments. I will not hold the massage therapist or Massage Club liable for any harm. Draping will be used during the session – only the area being worked on will be uncovered."

6. Cancellation and Refund Policy

Clients may cancel their booking at any time prior to confirmation by the massage therapist, with the pre-authorization hold being released in such cases. However, we have a 24-hour cancellation policy in effect.

If a client cancels a "Confirmed" appointment on the same day, they will have two options presented in their account from the booking status dropdown:

  1. Pay a $40 Short Notice Cancellation Fee: Clients can choose to pay this fee if they wish to update their reservation status to "Rebook," allowing them to maintain the current payment or credit on file. This fee compensates the therapist for their time, as we are obligated to cover a same-day cancellation fee from our end.

  2. Update to "Cancelled" Status: Clients can also choose to update their status to "Cancelled" without paying a fee. However, in this case, the credit or payment on file will be voided, and the client will not be able to reschedule that appointment.

If a client cancels outside of the 24-hour window (the day before the booking date or with more notice), there will be no fee. Clients can simply update the status to "Rebook" and reschedule at their convenience. The credit or payment on file will remain, allowing them to reset the same booking until the service is confirmed again and completed as expected.

Should you require a refund after a confirmed service, please email info@massageclub.ca if you are unable to rebook.

7. Right to Refuse Service

Massage Club and its massage professionals reserve the right to refuse service to any client for any reason, including but not limited to: intoxication, inappropriate or aggressive behavior, requests for services outside the scope of practice, or any situation that makes the massage professional feel unsafe or uncomfortable.

8. Data Privacy

Your privacy is important to us. Please refer to our Privacy Policy for details on how we collect, use, and protect your personal information.

9. Amendments to Terms

Massage Club reserves the right to modify these Terms at any time. Any changes will be posted on our website and will be effective immediately upon posting. Your continued use of our services following any changes signifies your acceptance of the new Terms.
